Clay's Job -
SanDog - 06-16-2006
I am starting this in a new thread.
Clay does not have a legal leg to stand on with his employer, using company resources and company time, and posting what could be construed as questionable material. He is done there.
However, the terms and conditions at CF has make it pretty clear that Clay could have a legal case against the owner of the board, and the member you did it. He is going to have to get the records of the e-mail fom his employer, which they are going to have to retain for unlawful termination claims.
Clay if you need any advice, feel free to PM me.

If the TOS have been violated, then I hope clay sues the crap outta them, wins a bundle and spends his time fishing, golfing and waterskiing on the local lake.

"Writing annoying, anonymous online posts or e-mails could land you in jail for as long as two years. That's according to the Violence Against Women and Department of Justice Reauthorization Act of 2005."
Who's to say that the "annoyee" couldn't cause a boatload of LEGAL trouble for cLaY? I think we can all agree that cLaY can be quite an annoying fuck.
I think it sucks what happened to him. It's fucked up. But to say that he has ANY legal standing in this?

I don't think so.
The fact is that he used company time and equipment for inappropriate (and arguably illegal) behavior. It doesn't matter who brought the matter to his employer's attention. That's like a drug dealer filing a civil suit against someone who turned him in to the police. Good luck.

I think you have to seperate the giving out the info and the email to the job.
No matter why he lost his job the real issue is the violation of the terms of the website.K.C would you let this place take your IP address and post your info without some type of action?

WTF was started by a group of people that quit UJ because they take the internet too seriously. Its always going to be that way. If you call one of them a fucktard, it hurts. It hurts so much that them calling you a butt head in return isn't enough. They have to do something that they know will "hurt" you. Ban you, delete you, post a picture of you, find where you work.
Face it, you get involved with them, and its going to get personal.

You nailed it, thats why I just want to find out who it was, call them out on it and leave these message boards behind me...not worth it to me.

Hey, I already said I think it sucks, but the suspect list is rather extensive...cLaY posts at more than one website, no?
Besides...who's to say that someone he knows in real life didn't decide to screw him? Plenty of people share snippets of what they do online with their real life acquaintances.

The case sited is not really relevant to this issue. As for legal standing, I would guess that would all depend on the TOS of the site in question, the way I read them you are wrong. What he posted is 1st ammendment protected, unless it was threats, and they cannot be construed that way based on tone and history, so your analogy does not jibe either.
You are entitled to your opinion, my CF compatriot, but we should really let the lawyers handle this.

Absolutely. The only person that you should be talking to is your lawyer.

I think if you've followed it from the get go its pretty obvious who's behind it.
Do you see any other names mentioned? The guy who did it basically threatened to do the same thing already except he was going straight to law enforcement.
