TAMPA, Florida (AP) -- A man tried to run over his ex-girlfriend with his pickup, but instead hit two children playing next door, killing a 2-year-old boy, police said.

Derrick McNeal, 36, fled after the crash Monday and abandoned his red Dodge pickup, and a search for him continued Tuesday, police said.

Police said McNeal saw his ex-girlfriend Tosha Shoundra Montgomery sitting outside a friend's house and tried to run her over.

Instead, McNeal hit a car, ran over a fence, drove through the yard, hit the two children, bumped Montgomery and crashed into the house, police said.

Two-year-old Demontay J. Simmons died at the scene. Four-year-old Toshayla Hall was treated at a hospital and released, and Montgomery was treated at the scene for minor injuries, police said.

First-degree murder and attempted first-degree murder warrants were issued late Monday, said Sgt. Jim Contento, a police spokesman. Police were using dogs and helicopters in the search.

McNeal was previously wanted on charges of aggravated stalking and throwing a deadly missile into an occupied vehicle.

I don't get how any of this is 1st Degree Murder. He didn't plan (beforehand) killing the toddler, or even his girlfriend. He was driving along, saw he and decided to kill her - that's 2nd Degree I think. Killing the kid by accident it something else, I am not sure what, but not 1st Degree :S

Driver aiming for ex-girlfriend kills toddler - SanDog - 07-05-2005

I gonna say vehicular manslaughter on the kid. I agree with your 1st degree assessment loo, unless he in is convicted of a killing while in the act of another crime (like shooting someone during a robbery). Then I think there are exceptions.

I think vehicular manslaughter is way too soft. I would think he ought to be charged with reckless homicide at a minimum. To call this manslaughter would make it about the same severity as someone felling asleep behind the wheel and accidentally causing an accident. This guy was trying to hurt someone, through his incompetence he missed his mark and killed a child. That’s homicide.

3st on the manslaughter thing but I think they should shove an m80 up his cornhole and toss him into the general population for as long as it takes to heal......I mean the dudes got issues to begin with. So what? He has to roll over a kid and his tonka truck before anybody pipes up?

The intent doesn’t necessarily have to be to kill for a homicide charge to apply. It’s like a person firing a gun into building. He may not know who, if anyone, he’s putting in danger, but it’s obvious someone could be killed by his actions. I looked up different homicide charges, and I think either of these could apply.

Reckless Homicide
The unlawful killing of another person with conscious indifference toward that person's life.
Vehicular Homicide
The killing of another person by one's unlawful or negligent operation of a motor vehicle.

Driver aiming for ex-girlfriend kills toddler - dora - 07-05-2005

They should charge him with whatever will keep him as someones prison bitch for the rest of his fucked up life

I knew about those, but I do degrees apply to those? I always thought they were seperate, like you had 1st Degree, 2nd Degree, Reckless Homicide, Vehicular, Felony Manslaughter, etc...

I concur. I stand corrected.

I was trying to find the legal definition for Felony Manslaughter, cause that sounded good, and it is what they charged that one Senator who killed the guy on a bicycle with, but I can't find a good definition.

Driver aiming for ex-girlfriend kills toddler - Beaucephus - 07-05-2005

Just my take and definitely not by any stated law, but it would seem to me the attempt of premeditated (1st degree) murder on the girlfriend would automatically institute 1st degree murder on the child being the fact he was collateral damage from the initial crime.
